These Terms and Conditions govern your use of The Appliance Doctor website and your interactions with The Appliance Doctor, including service requests, appointments, telephone calls, emails, and text message communications.

By using our website, requesting service, scheduling an appointment, or otherwise interacting with us, you agree to these Terms and Conditions.

2. Website Use

You may use our website only for lawful purposes.

You agree not to:

  • Use the website in a way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to the website, its server, or connected systems
  • Introduce viruses, malicious code, or other harmful technology
  • Interfere with the website’s operation, availability, or security
  • Use automated tools to scrape, copy, or extract website content without permission
  • Impersonate another person or submit false or misleading information
  • Use our website or communications systems to send spam or abusive content

We may restrict or terminate access to the website where we reasonably believe these Terms have been violated.

3. Service Requests and Appointments

Submitting a contact form, requesting an appointment, or using an online scheduling service does not guarantee that an appointment has been accepted or confirmed.

An appointment is considered confirmed only after you receive confirmation from The Appliance Doctor or its authorized scheduling provider.

You agree to provide accurate and complete information concerning:

  • Your name and contact details
  • The service location
  • The appliance, equipment, or system requiring service
  • Known problems or symptoms
  • Access requirements
  • Any relevant safety concerns

You are responsible for ensuring that an adult authorized to approve work is present at the service location unless other arrangements have been agreed upon.

Appointment times and arrival windows are estimates. Delays may occur because of traffic, weather, earlier service calls, technician availability, parts availability, emergencies, or circumstances outside our reasonable control.

4. Estimates, Pricing, and Authorization

Any price shown on the website is general information unless expressly identified as a binding offer.

Actual service costs may depend on factors including:

  • The equipment or appliance involved
  • The nature and extent of the problem
  • Diagnostic work required
  • Labor requirements
  • Parts and material availability
  • Travel or access conditions
  • Additional issues discovered during service

Where applicable, we will provide an estimate or obtain authorization before completing chargeable repair work beyond the agreed diagnostic or service fee.

An estimate is based on the information reasonably available at the time it is prepared. Additional problems discovered during a repair may require a revised estimate and additional authorization.

5. Service Charges and Payments

Service calls, inspections, diagnostics, labor, parts, materials, travel, and other work may be subject to charges.

Applicable charges will be communicated through an estimate, invoice, booking process, telephone conversation, or other service communication.

Payment is due according to the terms stated on the relevant estimate or invoice. You agree to pay all authorized charges associated with services provided to you.

Returned payments, disputed payments, overdue balances, or collection activity may result in additional charges where permitted by law.

6. Cancellations and Rescheduling

Please contact us as soon as possible if you need to cancel or reschedule an appointment.

We reserve the right to apply a cancellation, missed appointment, or additional travel charge where:

  • An appointment is cancelled without adequate notice
  • No authorized person is available when the technician arrives
  • The technician cannot safely or reasonably access the equipment
  • Incorrect service location information was provided
  • Conditions at the property prevent the scheduled work from being completed

Any applicable charge will be communicated where reasonably possible.

7. Access and Site Conditions

You are responsible for providing safe and reasonable access to the appliance, equipment, utilities, and service area.

Before the technician arrives, you should:

  • Remove personal belongings and obstructions from the work area
  • Secure pets
  • Inform us of known hazards
  • Ensure the property can be safely entered
  • Provide access to electrical panels, water shutoffs, gas shutoffs, or other utilities where relevant

We may decline, pause, or discontinue work where conditions are unsafe, unsanitary, inaccessible, unlawful, or materially different from those described when the appointment was scheduled.

8. Parts and Availability

Repair timelines may depend on the availability of replacement parts, manufacturer information, specialist equipment, and shipping.

We do not guarantee that every appliance or system can be repaired. Certain parts may be discontinued, delayed, backordered, unavailable, or economically impractical to obtain.

Dates provided for part delivery or repair completion are estimates unless expressly agreed otherwise in writing.

9. Warranties

Any warranty applying to our labor or supplied parts will be described on the applicable estimate, invoice, service document, or warranty notice.

Manufacturer warranties may be subject to separate manufacturer terms and claims procedures.

Unless otherwise stated in writing, warranties do not cover problems caused by:

  • Misuse, abuse, or neglect
  • Accidents or physical damage
  • Unauthorized repairs or modifications
  • Improper installation by another party
  • Electrical surges or utility failures
  • Water, fire, weather, pests, or environmental conditions
  • Failure to follow manufacturer instructions
  • Unrelated faults arising after the original service
  • Normal wear and tear

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

10. SMS and Text Messaging Terms

The Appliance Doctor SMS Program

When you provide your mobile telephone number and separately consent to receive text messages from The Appliance Doctor, you may receive SMS or MMS messages concerning:

  • Appointment confirmations
  • Appointment reminders
  • Scheduling and rescheduling
  • Technician arrival notifications
  • Service updates
  • Estimate and invoice information
  • Payment-related information
  • Responses to your questions
  • Customer care messages
  • Follow-up requests
  • Review requests
  • Promotional offers or marketing messages where you have specifically consented to receive them

Message frequency varies depending on your appointments, service activity, requests, and communication preferences.

Message and data rates may apply. Your mobile carrier’s standard messaging and data charges may apply to messages sent or received through the program.

Consent to receive text messages is not a condition of purchasing any goods or services.

Opting Out

You may cancel SMS communications at any time by replying STOP to a message from us.

After you send STOP, you may receive one final text message confirming that you have been unsubscribed. After that confirmation, you will no longer receive text messages from that messaging program unless you separately opt in again.

Where supported by the messaging platform, similar opt-out keywords may also be recognized.

Opting out of text messages does not prevent us from contacting you through another method where reasonably necessary to provide a service you requested, administer an existing appointment, collect an outstanding balance, address a safety issue, or comply with the law.

Eligibility and Mobile Number Responsibility

You must be at least 18 years old or have the permission of a parent or legal guardian to participate in our text messaging program.

By providing a mobile number, you represent that:

  • The number belongs to you or you are authorized to use it
  • You are authorized to consent to receive messages at that number
  • The information you provide is accurate

You agree to notify us or opt out if your mobile number changes or is transferred to another person.

SMS Privacy

Your participation in our SMS program is also governed by our Privacy Policy.

Mobile information and text messaging opt-in consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be provided to telecommunications carriers, messaging platforms, scheduling providers, and other service providers only as necessary to deliver and support our communications.

Changes to the SMS Program

We may modify, suspend, or discontinue the SMS program or any part of it at any time.

We may also change the telephone number or short code used to operate the program. If this occurs, messages sent to a discontinued number or code may not be received.

11. Email Communications

When you provide your email address, we may send communications relating to:

  • Service requests
  • Appointments
  • Estimates
  • Invoices
  • Payments
  • Customer support
  • Service follow-ups
  • Review requests
  • Promotional communications where permitted

You may unsubscribe from promotional emails using the unsubscribe link included in the email or by contacting us.

Unsubscribing from promotional emails will not prevent us from sending transactional or service-related communications.

12. Online Scheduling and Third-Party Services

Our website may use or link to third-party services for scheduling, payments, maps, reviews, analytics, communications, social media, and other functions.

When you use a third-party service, your use may also be governed by that provider’s terms and privacy policy.

We are not responsible for the content, availability, security, or privacy practices of independently operated third-party services.

You may not reproduce, republish, distribute, modify, sell, license, or commercially exploit website content without prior written permission.

14. Website Information

We make reasonable efforts to keep website information accurate and current. However, we do not guarantee that every description, price, service area, appointment time, image, or other item of information will always be complete, current, or error-free.

Website content is provided for general informational purposes and is not a substitute for an inspection, diagnosis, estimate, or professional assessment of a particular appliance or system.

We may correct errors and update website information without prior notice.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the website is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The website will always be available or uninterrupted
  • Website content will be free from errors
  • The website will be free from viruses or harmful components
  • Every service request will be accepted
  • Every appliance or system can be successfully repaired
  • A repair will be economically preferable to replacement

Nothing in this section excludes an express written warranty provided for specific work or any legal right that cannot be waived.

16. Limitation of Liability

To the fullest extent permitted by law, The Appliance Doctor will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the website or inability to access it.

For claims arising from paid services, our liability will be determined according to the applicable service agreement, estimate, invoice, warranty, and governing law.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Appliance Doctor and its owners, employees, contractors, and representatives from claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of the website
  • Your material violation of these Terms
  • False or unauthorized information submitted by you
  • Your infringement of another person’s rights

This section does not apply to the extent a claim was caused by The Appliance Doctor’s own unlawful conduct or negligence.

18. Privacy

Your use of the website and our handling of personal information are also governed by our Privacy Policy.

The Privacy Policy should be reviewed before submitting personal information or consenting to receive text messages.

19. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.

Any legal proceeding relating to these Terms or your use of the website will be brought in a court with appropriate jurisdiction in Colorado, unless applicable law requires otherwise.

20. Severability

If any part of these Terms is held to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

21. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

22. Changes to These Terms

We may revise these Terms periodically to reflect changes in our website, services, communications, business practices, or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.
